Q: Delineate Article 76 of Constitution of India ?

Ans: Article 76 deals with Attorney General for India and Attorney General is the first law officer of the country. 

(1) The President shall appoint a person who is qualified to be appointed a Judge of the Supreme Court to be Attorney General for India

(2) It shall be the duty of the Attorney General to give advice to the Government of India upon such legal matters, and to perform such other duties of a legal character, as may from time to time be referred or assigned to him by the President, and to discharge the functions conferred on him by or under this Constitution or any other law for the time being in force.

(3) In the performance of his duties the Attorney General shall have right of audience in all courts in the territory of India.

In common law, a right of audience is generally a right of a lawyer to appear and conduct proceedings in court on behalf of their client.


(4) The Attorney General shall hold office during the pleasure of the President, and shall receive such remuneration as the President may determine Conduct of Government Business


The Attorney General is a constitutional post but not a government servant and he is not debarred from private legal practice.

He is not a government servant as he is not paid fixed salary and his remuneration is decided by the president.

 The attorney general can accept cases but cannot appear against the Government. 

They cannot defend an accused in the criminal proceedings and can defend an accused in only civil proceedings and  can not accept the directorship of a company without the permission of the Government.

The Attorney-General has the right of pre-audience over all other advocates in accordance with section 23 of Advocates Act, 1961.
